These Terms of Service ("Terms") govern your access to and use of The Whimsical Humans website, products, memberships, subscriptions, content, features and related services. For the purposes of these Terms, “The Whimsical Humans”, “we”, “us” and “our” refer to JGB Curated Crafts Trading FZE LLC, trading as The Whimsical Humans. The words “you” and “your” refer to the customer, website visitor or person using our services. Our website and ecommerce services are powered by Shopify, which enables us to provide online store functionality, checkout, customer accounts, order processing, subscription management and related ecommerce services. Our memberships may include recurring monthly subscriptions through which members receive curated physical mail or packages containing items such as: • Letters • Postcards • Stationery • Stickers • Bookmarks • Art prints • Paper goods • Collectibles • Special-edition items • Other curated surprises The contents, themes, artwork, designs, quantities and presentation may vary from month to month. Eligibility By using our website or purchasing from us, you confirm that: 1. You are legally capable of entering into a binding agreement under the laws applicable to you; and 2. The information you provide to us is accurate, complete and current. If you are not legally permitted to enter into a purchase or subscription agreement in your jurisdiction, you must not purchase from us without the involvement of a parent, guardian or other legally authorised person where permitted by law. 3. These may include differences in: • Colour • Texture • Printing • Paper • Finishing • Packaging • Artwork placement • Dimensions • Decorative details • Handwritten or hand-finished elements Colours may also appear differently depending on your screen, device and display settings. Product photographs, illustrations, mock-ups and examples of previous membership contents may be used for illustrative purposes. Unless specifically stated otherwise, examples of previous mailings, letters, stationery or other products do not guarantee that identical items will appear in a future membership mailing. The curated nature of the membership means that monthly contents may change. 5. Availability All products, memberships, editions and subscription plans are subject to availability. We may: • Introduce new products or membership tiers • Change the contents of future membership editions • Limit quantities • Close membership enrolment • Introduce waiting lists • Discontinue products or plans • Restrict sales to particular countries or regions We may do so where reasonably necessary for operational, supply, creative, legal or commercial reasons. Please review your order carefully before completing checkout. 7. Subscription Memberships Certain memberships offered by The Whimsical Humans operate on a recurring subscription basis. Where a membership is described as monthly, your subscription will ordinarily continue and renew automatically each month until cancelled in accordance with the applicable cancellation terms. Our membership offerings may include plans such as: • Human Realm • Whimsical Realm The membership plans, names, prices, benefits and contents displayed on the website at the time you subscribe will apply to your purchase, subject to these Terms and any applicable Subscription Terms. A subscription constitutes an agreement between you and JGB Curated Crafts Trading FZE LLC, trading as The Whimsical Humans. 8. Automatic Renewal and Recurring Billing By purchasing a recurring subscription, you authorise the applicable payment provider to charge your selected payment method automatically for each recurring billing period until your subscription is cancelled. This means you do not need to place a new order manually each month. Unless otherwise stated at checkout: 1. Your first payment is charged when you start your subscription. 2. Your subscription renews automatically according to the billing frequency shown at checkout. 3. The payment method associated with your subscription may be charged automatically on each renewal date. 4. Your subscription remains active until cancelled, terminated or otherwise ended in accordance with these Terms. You are responsible for ensuring that your payment information remains valid and up to date. 9. Subscription Prices The subscription price applicable when you join will be displayed before you complete checkout. Unless otherwise stated, prices are shown in the currency displayed on our website. Where applicable, shipping, taxes, duties or other charges may be calculated separately and shown during checkout. We may change subscription prices from time to time. Where a price change affects an existing recurring subscription, we will provide notice where required by applicable law and give you the opportunity to cancel before the new price applies where legally required. A price change will not retroactively alter a charge that has already been validly processed. 10. Subscription Renewal Each successful subscription renewal creates or authorises the next applicable membership cycle. Your renewal date may be based on: • The date you originally subscribed • A fixed monthly billing date • Another schedule displayed during checkout or within your subscription account Renewal processing dates and shipping dates do not necessarily occur on the same day. The Whimsical Humans may operate monthly preparation, packing or dispatch cycles, meaning your membership package may be prepared and dispatched after your renewal payment has been processed. 11. Subscription Cancellation You may cancel your subscription using the cancellation options made available through your account, subscription-management page or by contacting us where applicable. Cancellation prevents future subscription renewals. Unless required otherwise by applicable law or expressly stated in our Return & Refund Policy, cancelling a subscription after a renewal payment has already been processed does not automatically cancel or refund that renewal order. If you do not wish to be charged for the next subscription cycle, you should cancel before the applicable renewal payment is processed. Failed Subscription Payments If a recurring payment is declined, fails or cannot be processed, we or our payment provider may attempt to process the payment again. During this period, your subscription may be placed: • On hold • In a payment-retry status • Inactive • Suspended If payment cannot be successfully collected, we may suspend or cancel your subscription. A membership package may not be prepared or dispatched until the applicable subscription payment has been successfully received. We are not responsible for fees charged by your bank, card issuer or payment provider in connection with failed payments, currency conversion or other financial-services charges. 13. Updating Payment Information You are responsible for maintaining valid and current payment information. If your card expires, is replaced or becomes unavailable, you should update your payment information through the available subscription-management facilities. We cannot guarantee fulfilment of a subscription cycle where payment has not been successfully received. 14. Shipping Address for Subscription Orders You are responsible for ensuring that your shipping address is complete and accurate. Where your subscription permits address updates, changes should be made before the relevant monthly order enters processing or fulfilment. An address change made after an order has already been packed, processed or transferred to a delivery provider may not affect that shipment. If a parcel is returned because the customer supplied an incorrect, incomplete or outdated address, additional postage or redelivery charges may apply where permitted by law. The total amount payable will normally be displayed at checkout before you complete your purchase. Shopify provides technology that enables us to operate aspects of our website, checkout, customer accounts and ecommerce services. However, purchases made through The Whimsical Humans are purchases from JGB Curated Crafts Trading FZE LLC, trading as The Whimsical Humans, not from Shopify. Shopify is not the seller of our products or memberships. Certain information may be processed by Shopify in connection with your use of the website, checkout, orders, subscriptions and payments.
